Dividing a House – When Young Children are Involved

Let’s keep in mind that Divorce is hard enough on the adults and super tough on the children.  So when there is Shared Custody, now the Children are involved and keeping the main home may be a very viable option and alternative.

Decide who will keep the main home and the terms and then decide if the other spouse will then purchase or rent a second property ( townhouse, condo, single family home ).  So how this works, for example is, the parent that does not have time with the children, will stay in the secondary property and the parent with the children will be at the “children’s home”.  This helps the children remain in their home and not be shuffled between two places.

In the secondary property, the ex’s could then each have their own room ( lock the door if needed when not in residence ) and the rest of the place is common space.  All terms should be agreed to as to who is responsible for upkeep, maintenance, etc. of the common space.  Set up rules and guidelines, as your attorney to help, and don’t forget the exit clause when one wants to sell or the children are no longer minors.  I can also help get the basics started for you and finish the legal bits with the respective attorneys.
